ProxyRed Terms and Conditions

Introduction

This License Agreement (the “Agreement“) is an agreement between ProxyRed and you or the entity you represent (“Customer“ or “you”). This Agreement takes effect when you sign ProxyRed Service Order or when you access or use any component of ProxyRed System, as applicable (the “Effective Date“).

By creating an account, clicking “I agree”, or accessing/using any part of the System, you confirm that you have read, understood, and agree to be bound by this Agreement.

Changes to These Terms

ProxyRed may update these Terms from time to time. The “Last modified” date indicates when changes were made. Continued use of the System after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the System.

Grant of License

During the term of this Agreement, ProxyRed grants the Customer a limited license (with no right to sublicense, unless confirmed in writing) to access and use the System for the Purpose.

ProxyRed reserves any and all rights not expressly granted in this Agreement, including, without limitation, any and all rights to the System.

Warranties, Representations and Undertaking by the Customer

1. Not use the System intentionally in violation of applicable law or regulations or any third-party rights (including intellectual property rights), or for governmental uses.
2. Not use the license to the System granted herein to distribute malicious software or engage in unlawful activities..
3. Be solely responsible for any Third-Party Content accessed using the System and ensure compliance with applicable laws and third-party rights.
4. Indemnify ProxyRed against any claims arising from the use of the System.
5. Not use the System for abusive automated account creation, credential stuffing, or actions intended to bypass security, access controls, or anti-fraud mechanisms of third parties.

Payment and Consideration

1. You are required to provide ProxyRed with all necessary co-operation in relation to this Agreement and all necessary information as may be required by ProxyRed for your account, including personal and access related information as well as payment information, in each case, to enable ProxyRed to provide the requested service and to allow your use of the System. You assume full responsibility that such information is current, complete and accurate. You warrant that information that you provide to us will be truthful, accurate, and complete, and that you are authorized to provide such information. You authorize us to verify your information at our own discretion and at any time.
2. If your billing information and payment source is invalid, if charges billed to you are declined or not paid or if you fail to pay charges for a paid version of ProxyRed’s services when due, your account may be downgraded, suspended or cancelled, at ProxyRed’s discretion.
3. Prices for the ProxyRed services are stated on ProxyRed’s website and may change from time to time at ProxyRed’s sole discretion. Prices are net of any withholding or other taxes and the Customer shall be responsible for payment of all such applicable taxes, levies, or duties.
4. Please be informed that in order to comply with anti-money laundering (AML) standards, your transaction will undergo a verification process. If the cryptocurrency you have sent is associated with high risk or originates from illegitimate sources, we reserve the right to conduct additional identity verification. Kindly note that transactions from exchanges under sanctions (such as Garantex, Hydra Market, Tornado Cash, and others) as well as transactions from Iranian exchanges (such as Nobitex.ir, arzpaya.com, abantether.com) will be subject to delay and freezing by our AML department. Consequently, proxy usage services are temporarily suspended. Failure to provide the necessary information will result in the suspension of our services.
5. ProxyRed’s order process may be conducted and handled by online reseller/s. We currently operate with Cryptomus. Cryptomus is the Merchant of Record for all our orders. Payment processing and compliance procedures are provided by Cryptomus. Any inquiries related to payment processing may be handled in accordance with Cryptomus policies.
6. All payments are final and non-refundable. ProxyRed does not provide refunds or credits for partially used periods, unused services, or dissatisfaction with results. Any payment disputes are handled by the Merchant of Record / payment processor in accordance with their policies.
7. The Customer acknowledges that access to the System is provided immediately after activation and is delivered on a time-based basis for the selected term.
8. No Pause / Freeze. Suspension, pausing, freezing, extension, or carry-over of the billing period is not provided unless explicitly stated in the purchased plan.
9. ProxyRed does not guarantee that the System will work with every third-party software, website, or service. Any limitations, blocks, or restrictions imposed by third parties are outside of ProxyRed’s control.

Suspension

ProxyRed may suspend Customer's right to access or use the System if it determines that the Customer's use poses a security risk, may adversely impact the System, or is in breach of this Agreement, including if Customer is violating its payment obligations.

Fair Use and Technical Limits

ProxyRed may enforce technical limits to protect service stability and prevent abuse (including but not limited to: rate limiting, connection limits, concurrency limits, and restrictions by destination or protocol). Excessive load, automated abuse, or usage that negatively impacts the System may result in temporary restrictions or suspension without refund.

Limits may vary by location, network type, and plan.

Acceptable Use Policy (AUP)

The Customer agrees not to use the System for any unlawful, harmful, or abusive activities. Prohibited activities include, but are not limited to:

1. Sending spam, phishing, or unsolicited communications.
2. Distributing malware, spyware, ransomware, or engaging in hacking activities.
3. Credential stuffing, brute-force attacks, or bypassing authentication mechanisms.
4. Automated mass account creation or actions intended to circumvent third-party rate limits or anti-fraud systems.
5. Accessing, scraping, or interacting with third-party services in violation of their terms.
6. Engaging in activities that may disrupt, overload, or damage the System or other users.

ProxyRed reserves the right to restrict, suspend, or terminate access without prior notice if it determines that the Customer is in breach of this policy. Such actions do not entitle the Customer to any refund or compensation.

Customer Environment and Compatibility

The Customer is responsible for configuring and maintaining their own software, servers, and network access. ProxyRed is not responsible for issues caused by the Customer’s environment, third-party tools, browser extensions, hosting providers, firewalls, or ISP restrictions.

Residential Pool and IP Allocation

Residential IP pools are dynamic by nature. ProxyRed does not guarantee a specific number of unique subnets, IPs, ASNs, or uninterrupted availability of any particular IP. IP allocation, rotation behavior, and pool composition may vary over time and by location.

Account Policy and Multi‑Account Prohibition

1. One account per individual or legal entity. Creating, maintaining, or using multiple accounts to bypass limits, purchase more than the allowed number of $3 tests, obtain promotions more than once, or otherwise gain an unfair advantage is strictly prohibited.
2. The $3 test is limited to one purchase per test type per account and per user. Attempts to circumvent this restriction through additional accounts are a breach of these Terms.
3. Enforcement. To prevent abuse, we may use reasonable anti‑fraud measures, including rate‑limiting, IP and device‑level checks, and consistency checks across technical identifiers, in accordance with our Privacy Policy.
4. Remedies. We may deny service, cancel orders, revoke tests, suspend or terminate accounts, and forfeit benefits obtained through policy violations, without refund.

Disclosure of Information

ProxyRed shall have the right, but not the obligation, to monitor Customer’s use of the System for billing purposes and to verify no misuse or network abuse. ProxyRed may share the Customer’s relevant information with any authority in case of a complaint, lawsuit or demand, if ProxyRed determines that it is necessary to comply with law, regulation, subpoena or court order.

Term and Termination

1. Either party may terminate this Agreement at any time by providing the other party with a written notice of termination. The termination will take effect at the end of the calendar month in which the notice is received.
2. ProxyRed reserves the right to terminate this Agreement immediately, without notice, if the Customer breaches any terms of this Agreement, engages in unlawful activities, or if ProxyRed determines that the Customer's actions pose a risk to the System or other users.
3. Upon termination of this Agreement, the Customer shall immediately cease all use of the System and any outstanding payments shall become due and payable.
4. Termination of this Agreement shall not affect any rights or obligations of the parties that have accrued prior to the date of termination.
5. ProxyRed shall not be liable to the Customer or any third party for any damages or losses resulting from the termination of this Agreement.
6. Termination or suspension of the Customer’s access does not entitle the Customer to any refund, credit, or compensation, except where required by applicable law.

Disclaimer of Warranties

ProxyRed provides the System on an “as is” and “as available” basis and disclaims any warranties of merchantability, suitability, or fitness for a particular purpose. ProxyRed does not warrant that the System will meet your requirements or that the operation of the System will be uninterrupted or error-free.

ProxyRed makes no representations or warranties of any kind, express or implied, as to the operation of the System or the information, content, materials, or products included on the System. You expressly agree that your use of the System is at your sole risk.

To the fullest extent permissible by applicable law, ProxyRed disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. ProxyRed does not warrant that the System, its servers, or e-mails sent from ProxyRed are free of viruses or other harmful components. ProxyRed will not be liable for any damages of any kind arising from the use of the System, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above exclusions may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

ProxyRed does not provide any service level agreement (SLA) unless explicitly stated in writing. Temporary interruptions, maintenance, or network issues may occur.
